Maximise Your R&D Potential – Enhanced Tax Incentives with The Forschungszulage (FzulG)
The Act on Tax Incentives for Research and Development (FZuIG), introduced on 1st January 2020, was enacted to encourage R&D investments throughout Germany that benefit companies of all sizes and industries.
The aim of the law is to position Germany as a leading investment location and to promote innovation, especially in small and medium-sized enterprises (SMEs).

What is the Forschungszulage?
The Forschungszulage (FZulG) is a tax incentive program created by the Bundesministerium für Bildung und Forschung (BMBF) to incentivise companies to innovate in Germany.
For R&D activities initiated from 2nd January 2020, companies can receive up to €1 million annually, covering 25% of internal R&D personnel costs and 15% of external R&D costs.
The funding limit, starting 27th March 2024, has increased to €10 million, with SMEs entitled to a reimbursement of 35%*, while the coverage of external R&D costs will increase to 24.5%. **
Alongside this change, movable and depreciable assets are now part of eligible expenses.

Eligibility Criteria for R&D Activities
As per Regulation (EU) No. 651/2014 (p. 24f.), research and development (R&D) activities are defined as:
Basic research
Experimental or theoretical work that is primarily aimed at acquiring new basic knowledge with no evident direct commercial application.
Industrial research
Systematic or critical research to gain new knowledge and skills with the aim of developing new products, processes or services or bringing about significant improvements in existing products, processes or services.
This includes the development of parts of complex systems and, in some cases, the construction of prototypes in a laboratory environment or in an environment with simulated interfaces to existing systems, as well as pilot lines, where this is necessary for industrial research, and particularly the validation of technological bases.
Experimental development
The acquisition, combination, design and use of existing scientific, technical, economic and other relevant knowledge and skills with the aim of developing new or improved products, processes or services.
This includes, for example, activities related to the design, planning and documentation of new products, processes and services.
